Wouldn't it just be better to change the name of the website as opposed to
throwing out the baby with the bathwater?

I think they must be pulling your leg, or at least trying to intimidate you. Just
look in the phone book yellow pages. You will find dozens of references to "shack".
BBQ Shack, "Lobster Shack" etc. If I "shack up" with a girl, will that confuse
someone into thinking my pad is a radio shack store?

***** IMPORTANT INFORMATION *****  Scan Shack web site is closing !!!

This message is to inform all of the closing down of the Scan Shack Web Site.
I received an e-mail from Tandy Corp (Radio Shack) saying if I did not do what
they asked in the message, action would be taken against me.  I include the
e-mail below.
I will continue with the Adventures of Scanner Dweeb comic strip though which
will continue to be located at the URL:
http://members.aol.com/ScannerDweeb
I hope you all found some "good" value from the Scan Shack web site when it was
up and running.
Thanks to all who visited it..... Please continue to visit the Scanner Dweeb
site.
Below is the e-mail I received from Tandy..... as written.

Subj:    Use of our registered mark "SHACK"
Date:   10/5/99 3:43:33 PM Mountain Daylight Time

Tandy is concerned about your use of its "SHACK" registered mark as your
business name and internet site name.  In the event that you were not aware,
you are hereby advised that Technology Properties, Inc. (TPI) owns numerous
federal registrations for its internationally recognized RADIOSHACK and
family of other SHACK marks for a wide variety of consumer products and
services, including scanners.  Millions of dollars are spent annually by
Tandy, the exclusive licensee of TPI, advertising products and services
using these marks.  the SHACK mark is of enormous value to TPI.  Further
Tandy as a responsible company has worked hard with local, state and federal
legislators to ensure that proper use of scanners.
You site appears to be one devoted to information exchange leading to the
unauthorized modification of scanners for potentially illegal scanning.
Your use of our SHACK name and products on your site is no authorized by
anyone at Tandy.  Your use of TPI's registered SHACK name as your site name
is likely to confuse the public into believing that is an affiliation
between you operation and Tandy's SHACK operations. You may not realize that
you are not permitted to incorporate another's trademark or service mark
into your own site name.  This association dilutes the strength and
integrity of our SHACK mark.
Tandy must insist that you immediately cease using its "SHACK" mark as any
part of your business's name or in your internet address.
Nothing in this e-mail represents an admission by Tandy or TPI that you have
any righ5s in or to the "SHACK" name or mark.  Tandy and TPI are merely
attempting to inform you of their concerns and notify you of their rights
before circumstances necessitate further action.

As you know, Tandy Corporation is entitled to protect its intellectual property.

We will be notifying the owners of some 300,590 web pages that contain the
word "shack" that it is our intention to pursue legal redress if they do not
remove the word "shack" from said web pages immediately.

Be assured that we will be taking the same action in cases where words similar to "shack"
have been used.

In addition to "The Scan Shack", we have already notified the owners of the following
properties that infringe upon our trademark:

Sugar Shack      - a song played on "Oldies" stations
Caddie Shack     - a movie starring Bill Murray
Shaq             - some sort of sports icon

To avoid further action, you would be well advised to avoid using the
Tandy-trademarked word "Radio" on any web pages.

Like, "shack" as in "radio shack" is a Tandy invention ?
Looks like they are using their $$$ as a means of scaring off the
little guys.
Shit....I thought "radio shack" had been in use for around 80 + -
years.....most ships had one in WW2 . Tandy/RS wasn't around ,then.

Why not simply rename your site?  That way you can keep it all.

Sure they did.The dictionary defines SHACK as this: A small crude dwelling  where Tandy sells crappy electronic goods. These miserable shacks are so low that their occupants cannot stand erect.

Simple, rename your site the "Scan Hacks", they are as silly as Domino
Sugar(TM) going after Dominao Piza ten years ago.  And guese who won
that one?  It is really nice that they are so defensive of their name.
I guese us hams had better stop calling our communication center the
"ham shack" or Tandy (TM) will come down on us.
Like they always say "you've got questions and we have not got a clue".
I am sorry to see you site go dark because of the strong armed tactics
of a business bully.  While I know that the scanning community is
unimportant to Tandy, it still sucks.  As history shows, bullies always
get theirs in the end. Someday, some upstart business will eat them and
that day can not be too far, after all how can any company survive with
such pathetic employees and products.

As to Tandy and their heavy handed tactics.

Just look at what happened to the "Tandy Computer Centers". Back in the mid
eighties they were trying to corner the business computer market.

It didn't happen then and all they will get from this latest move is less
business.

Regards,

Ed

What a great idea.  Sell computers half as advanced as what is available
elsewhere for twice the price.

"Incredible Universe" wasn't exactly a stellar success, either.

Why give in at ALL to these shysters?

AOL pulled the same ***when someone put up an "aolsucks.com" Web site,
remember?  But that particular Webmaster called their bluff.  The site is still
up today.

"You've got questions, we've got lawyers."

Oops...gee, Tandy....I hope that didn't infringe on your "intellectual

The way I heard it....  (I had no official interaction or knowledge on
this, just the rumor mills)

Actually, they do.  There used to be a place called the "HAM Shack"
that was forced to change it's name to "Ham Station" a number of
years ago.  They made a real pissy announcement about it at the
time too.

Tandy actually ignored the reference to "Shack" when used by others
until one enterprising individual started something called "Shak
Electronics" or something similar.  That got Tandy moving, and legally
they had to enforce all or nothing.  (Sounds like McDougals burgers
from the movie Coming to America!)

Don't blame Tandy on this one, it's the legal system.  All or nothing.
And an individual that wanted to push the envelope.

Mike
