So, take "SHACK" out of your vocabulary

So, Tandy will sue anyone who has the word "SHACK" in their business
name
or in their motto?

Well, let's just remove SHACK from the English language less we make
reference to an "out house" and get sued as a result.

Shack is not their name, "Radio Shack" is.  How can you copyright /
trademark a word that is not even your company's name, just one word
of the name?

Am I missing the joke or is this for real?

Probably not.  Since when is legal notice served by E-mail?  If someone gets
a certified letter from an attorney, then maybe they should become
concerned.

I think that the ScanShack should be renamed Scanners R Us.

BTW:  The Shack is trademarked by RadioShack.  Go to www.theshack.com and
see where you wind up.

I believe McDonalds has a trademark on the name Mickey D's.

RadioShack sued Auto Shack.  They are now called Auto Zone.

RadioShack probably has about a dozen trademark names.  Micronta, Optimus,
Patrolman (remember their old scanners?  They still trademark that name.),
Chronosette, Plug N Power, AntennaCraft, and a whole lot more.

Right.   THE Shack is trademarked.  _______ Shack is NOT.  If it were, you can
bet your Archer Space Patrols that Tandy's sue-hungry legal team would be busy
sending cease and desist orders to every Pizza Shack, Chicken Shack, and Burger
Shack in the free world.

I wonder if they trademarked "Dickheads"?

No, 'Dickheads' is for people who aren't lawyers, don't understand
or know the law, but try to make policy.

Actually (trying to avoid falling into the***head classification here)
I believe a trademark holder has to show some possibility of
consumer confusion.  I read that Beretta vs GM, for example, was
originally thrown out, or argued to be thrown out, since GM maintained
there was no way consumers could mistake the name as
representative of Pietro Beretta, the weapons manufacturer (with
a 450 year history to back them up!).  However Beretta countered
with the fact they do in fact market 'automotive' novelty products
(although not that widely, but that didn't matter) with their name on
them.

Tandy probably couldn't successfully go after a Pizza Shack.  But
notice that I said 'probably' and 'successfully'.  The internet and
wide area e-marketing have blurred what the courts consider
trademark infringements.

I took Radio Shack out of my language years ago when they began charging for
their catalogs.  Haven't seen one since.

They seem to have learned from their mistake here.  Haven't been charged for
the catalog the past two years.

Ow, that made my side hurt from laughing so hard!  What about "Radio
Trash"?

By the way ... I am copyrighting the letter "B", since, in addition to
being the first letter of my last name, some people actually refer to
me as B.  Therefore, please discontinue using the letter "B" in all
future product names, company names, person names, sentences or words.

We now return you to your regularly scheduled newsgroup, already in
progress.
